Understanding VAT (Umsatzsteuer) · 2.6
Is the small business regulation worth it for me?
Short answer
It mainly depends on who your clients are and how much you invest at the beginning. With business clients and high investments, standard taxation is usually better; with private consumers and few expenses, the small business regulation (Kleinunternehmerregelung) can be suitable.
Key points
- Business clients: They recover the VAT as input tax (Vorsteuer). For them, your price remains the same, so standard taxation costs you nothing.
- Private consumers: They actually pay the 19%. As a small business owner, you are cheaper or have a higher margin.
- Investments: Under standard taxation, you get the input tax back on laptops, software, or agency costs. Under the small business regulation, you do not.
- Administrative effort: Standard taxation means advance VAT returns and an annual return.
You can voluntarily waive the small business regulation, but you are then bound by that choice for several years. Those who have business clients and want to grow often exceed the threshold soon anyway.
Figures & thresholds (as of November 2026)
- Binding period upon voluntary waiver: at least 5 calendar years
- If the regulation ends because the threshold was exceeded, you can switch back as soon as you fall below it again
