The Tax Office Estimated Taxes: What Now?
Short answer
If your company does not file a tax return, the Finanzamt (tax office) is allowed to estimate the tax base—and it usually estimates on the high side. The solution: promptly submit the return and file an objection at the same time while the deadline is still open.
Key points
- A Schätzungsbescheid (estimated tax assessment) is a real tax assessment. The tax becomes due even if the numbers are incorrect.
- Lodge an Einspruch (objection) within one month and submit the complete tax return.
- Apply for Aussetzung der Vollziehung (suspension of enforcement) for the overestimated portion if you do not want to pay upfront.
- If the assessment is issued under Vorbehalt der Nachprüfung (subject to review), it can still be amended after the objection deadline expires. However, do not rely on this.
- A Verspätungszuschlag (late filing penalty) is usually added as well.
